The validity of this information notice is limited t the Website only and does not extend to other websites, online pages or services that may be accessed via hypertext links, that might be published on the website, but referring to resources outside the Website itself. More specific information notices might be published on the Website pages set up to provide certain services.

Data controller

The controller of the processing of the data collected via the Website is Immergas S.p.A. with registered office in Via Cisa Ligure 95, 42041, Brescello, Reggio Emilia (hereinafter “Immergas”). The contact person for privacy is the “pro tempore” person in charge of the Information Systems department of Immergas, whom users of the Website may contact by sending an email to, or by surface mail sent to the data controller’s address, to exercise their rights.

Registered users: these are the users who have the personal credentials required to access the “restricted” areas or section of the Website
Unregistered users: these are the users who do not have personal credentials and who may access the “public” areas or section of the Website.

Data provided directly and intentionally by the users

According to the needs expressed from time to time, the users who interact with the Website may provide their contact data directly and intentionally, through the Website (e.g. name, surname, email address) as well as other personal data included in communications with the data controller.

Data acquired automatically through browsing

During their normal operation, the computer systems and software procedures that operate the Website acquire some personal data, whose transmission is implicit in the use of Internet communication protocols. This category of data includes the IP addresses or domain names of the computers and terminals used by users, addresses in URI/URL (Uniform Resource Identifier/Locator) notation of the requested resources, the time of the request, the method used in submitting the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server (successful, error, etc.) and other parameters related to the operating system and the user's computer environment.


The Website uses cookies, i.e. small text files that the websites send to the users’ computer or mobile devices, where they are stored. The personal data provided directly and intentionally are processed, with the user’s consent, for the following purposes:

Registered user:

Allow the user to sign in on the Website, where required to access “restricted” areas or sections and to provide and manage the services offered by the Website;

Offer services or initiatives organised by Immergas.

The data acquired automatically through navigation, required to use the web services, and the cookies may be processed, without the user’s consent, for the legitimate interest of the data controller to perform statistical analyses in aggregate form on Website use in order t improve – where possible – the user experience of the services provided by the Website.


The personal data are not processed via an automated decision-making process, including profiling, whereby profiling refers to any form of automated processing of the personal data aimed at analysing or foreseeing certain personal aspects including, by way of example, personal preferences, interests or behaviour of the Website users.

Nature of the provision of the users’ personal data

Except where specified for the navigation data, the provision of personal data is always optional. However it should be noted that, in the event of failure by the user to provide the personal data, the data controller might not be able to provide the service requested from time to time.

Recipients of the personal data

The personal data of the Website users may be disclosed by the data controller to third party entities (e.g., entities who are entrusted with technical support activities, the promotion and sale of products and/or services, IT service providers, professional firms etc.) to perform processing operations connected to the aims specified in this information notice and which, in that case, are appointed beforehand by the data controller as person in charge of processing pursuant to art. 28 of the Regulation. The people expressly authorised by the data controller or by the person in charge of processing may become aware of the personal data of Website users.

Transfer of personal data outside the European Union

The personal data are not subject to transfer to third countries or international organisations outside the European Union.

Retention period of your personal data

Unregistered user: processing of the data provided directly and intentionally has a duration no higher than that required to achieve the purposes for which the data were collected (for example, if you requested information on a product or service, processing will end upon sending the requested information). The personal data may be stored by the data controller for the maximum period of 36 (thirty-six) months.
Registered user: the personal data are stored for the entire duration of registration to the Website and subsequently, for the time strictly required to perform any fiscal and/or legal fulfilments by the data controller.
The data acquired automatically through navigation are stored for the maximum period of 2 (two) months.

Rights of the data subject

With regard to the personal data, the Website user may exercise the rights under the Regulation set out below.

art. 7 Right to withdraw consent. The data subject shall have the right to withdraw his or her consent at any time. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal.

art. 15 Right of access. The data subject shall have the right to obtain from the controller confirmation as to whether or not personal data concerning him or her are being processed, and, where that is the case, access to the personal data. When requested by the data subject, the controller shall provide a copy of the personal data undergoing processing.

art. 16 Right to rectification. The data subject shall have the right to obtain from the controller without undue delay the rectification of inaccurate personal data concerning him or her and the right to have incomplete personal data completed.

art. 17 Right to erasure (so-called “right to be forgotten”). The data subject shall have the right to obtain from the controller the erasure of personal data concerning him or her without undue delay and the controller shall have the obligation to erase personal data without undue delay and within the limits as provided for by art. 17 of the Regulation.

art. 18 Right to restriction of processing. The data subject shall have the right to obtain from the controller restriction of processing in the cases envisaged by article 18 of the Regulation.

art. 19 Notification obligation regarding rectification or erasure of personal data or restriction of processing. The controller shall communicate any rectification or erasure of personal data or restriction of processing carried out to each recipient to whom the personal data have been disclosed, unless this proves impossible or involves disproportionate effort. The controller shall inform the data subject about those recipients if the data subject requests it.

art. 20 Right to data portability. The data subject shall have the right to receive the personal data concerning him or her, which he or she has provided to a controller, in a structured, commonly used and machine-readable format and have the right to transmit those data to another controller without hindrance from the controller to which the personal data have been provided, where the processing is based on consent or on a contract and the processing is carried out by automated means.

art. 21 Right to object. The data subject shall have the right to object, on grounds relating to his or her particular situation, at any time to processing of personal data concerning him or her. The controller shall no longer process the personal data unless the controller demonstrates compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject or for the establishment, exercise or defence of legal claims.

art. 22 Automated individual decision-making, including profiling. The data subject shall have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning him or her or similarly significantly affects him or her.

art. 77 Right to lodge a complaint with a supervisory authority. Without prejudice to any other administrative or judicial remedy, every data subject shall have the right to lodge a complaint with a supervisory authority, in particular in the Member State of his or her habitual residence, place of work or place of the alleged infringement if the data subject considers that the processing of personal data relating to him or her infringes this Regulation (art. 79 of the Regulation).
